Canada's Anti-Spam Legislation: It’s not too late to comply!

The announcement of Canada’s new anti-spam legislation has generated buzz around the Canadian marketing and business world. There are many articles, and a few rumors floating around about the new guidelines, but here are some quick tips that hopefully wont leave you asleep at your desk.

Canada’s Anti-Spam Legislation (CASL)  will be enforced in three stages:

  • CASL will take effect July 1st
  • The provisions relating to unsolicited installation of computer programs or software will come into force on January 15, 2015
  • The private right of action will be enforced as of July 1st, 2017

Implied Consent

  • Existing business relationship - recipient has made, or inquired about a purchase.
  • Existing non-business relationship - recipient has provided gift/donation to charity, or political party.
  • Conspicuously published email - address was disclosed without any restriction and your message relates to the recipients function or activities. 

Express Consent

  • Valid consent given in writing or orally - the recipient gave you a positive or explicit indication of consent to receive commercial electronic messages. 

Basically, the new legislation will enforce any false or misleading internet and wireless telecommunication threats.
